Payday loans in West Virginia

So the practical answer to “can I get a payday loan here” is no — and the more useful question becomes what to do about a loan you already have, most likely from an online or tribal-affiliated lender reaching in from outside.

West Virginia bans the mechanism, not just the price

Most prohibition states get there through a usury cap. That is a stronger form of prohibition. A lender cannot comply by lowering the rate, because it is the structure that is barred.

If you already have one of these loans

A loan made above the state’s ceiling by a lender without a state licence is outside the law here, whatever the agreement says. That does not automatically settle what you owe — that depends on the loan, the lender and where it was made — but it means any collection attempt deserves scrutiny rather than compliance.

Two claims lenders make to get around a state ban

Tribal affiliation. Several online lenders assert sovereign immunity from state caps and licensing. Whether that holds has been litigated repeatedly with mixed outcomes. Nine such lenders appear in our directory.

Choice of law. An agreement stating that another state’s law governs is frequently contested and is a question for a lawyer, not something to accept from the lender.

A note on the rate figure on this page

That payday lending is not viable here is well established and current. The specific cap figure is less certain.

Published compilations disagree with each other on several of these states — one lists Connecticut at 30.3%, another at 12%; one puts Georgia at 16%, another at 60%. We have already verified both of those directly and found both sets of numbers misleading in different ways.
